Court Report 1

One of the suspects involved in a break and enter at a rural property has been granted bail.

Tyler Morgan Peters was arrested on Feb. 22 after Bonnyville RCMP were called to a break and enter in progress at 10 a.m.

The complainant said two males with weapons had barricaded themselves inside of his garage and had threatened to shoot him.

Officers attended, and Peters, along with a youth, were arrested.

Police found a truck not far from the property, and when they ran the plates, determined it had been stolen out of Cold Lake.

Drivers' licenses and the magazine for a weapon had been found inside of the garage near where the suspects had been arrested.

As a result, Peters has been charged with break and enter with intent, operation of a motor vehicle while prohibited, possession of stolen property, and possession of a prohibited weapon.

According to Peters, the IDs and magazine weren't theirs.

During his appearance in the Bonnyville Provincial Courthouse on Tuesday, March 5, the accused claimed he had been working on the youth's father's vehicle when the youth offered to give him a ride.

As they were driving, the tire blew or they had other car trouble and they had to pullover.

They spotted a farmer working on his property and went to speak to him, but by the time they got to where he was, he had left.

The suspects were inside of the garage when they were confronted by the farmer with a rifle, detailed Peters' defence counsellor Hart Spencer.

"He claimed he would shoot to kill," Spencer added.

Spencer believed Peters could be released on conditions, however, St. Paul's chief Crown prosecutor Jordan Kerr disagreed.

"He has a track record of failing to comply with court orders," Kerr stressed, stating since 2013, Peters has been convicted of possession of stolen property 20 times.

Kerr also noted the weapons offences.

"He's an individual who's repeatedly armed himself while he's doing these things."

The likelihood of re-offending while on release was among the reasons why the Crown was opposed to sentencing.

The Tofield resident was granted $750 cash bail by Honourable Judge Ivan Ladouceur.

His conditions are to keep the peace, be of good behaviour, report to a bail supervisor, have no contact with the victim or co-accused, not to attend Bonnyville unless for court, and not to possess any weapons.

Peters' next court appearance is March 26.
