Thirty-day sentence for failing to comply with probation order

BONNYVILLE - The youth convicted of bringing a firearm to Bonnyville Centralized High School was sentenced to serve time behind bars after failing to comply with the conditions of his probation order. 

The now 19-year-old, who can't be named under the Youth Criminal Justice Act, failed to follow the rules of the probation order he was sentenced to after bringing a handgun and ammunition to school in 2018. 

According to St. Paul chief Crown prosecutor Jordan Kerr, during the accused's appearance in court via CCTV on March 3, the then-youth offender had been sentenced in October 2018 to serve 50 hours of community service as part of his probation after pleading guilty to charges stemming from the firearm-related incident. 

He has already been charged previously with failing to comply with probation and was sentenced to complete an additional 60 hours of community service. 

Kerr noted the accused had made no attempts to complete either sentence. 

In addition to pleading guilty to failing to comply, the accused offered a guilty plea for failing to show up for court in December 2019. 

The Crown was seeking 30 days in prison. 

Defence counsel, Hart Spencer, didn't feel his client was "completely blowing off" the conditions of his probation order. In fact, according to Spencer, the accused had met all of the other requirements, including meeting with probation. 

Spencer noted after his initial sentencing in October 2018, his client had moved out of his grandparents home and was living on his own for the first time, a decision that may have been his downfall. 

Honourable Judge Kathleen Williams agreed with the joint submission for 30 days in jail. 

The accused has been in custody since Feb. 4, and was releasable on a time-served basis, however, he was also being held on sexual assault allegations. During his court appearance, he requested his bail be dropped from the original $2,500 ask to $1,000, which was granted. 

He will appear in court to speak to the sexual assault charges for a preliminary inquiry scheduled for June 30.
