Fleeing police and weapons offences lands man nine months in custody

Stanley Rene Mountain was sentenced to nine months in prison after pleading guilty to weapons-related offences, feeling from police, and possessing stolen property.

During his appearance in Bonnyville court on Tuesday, May 28, Mountain pleaded guilty to possession of a prohibited/restricted weapon, carless use/storage of a firearm, two counts of breaching probation, failing to attend court, possession of property obtained by crime, and resisting arrest.

Bonnyville RCMP attended a Kehewin home at 11 a.m. on July 19, 2018 after a complaint that a male had been shooting a firearm at a black bear in a residential area before leaving in a car.

Police began patrolling the area, and located a vehicle that matched the description of the suspect car at a Kehewin residence.

The vehicle was leaving the property when RCMP pulled it over.

The driver told the officer that Mountain, who was sitting in the backseat, was the man they were looking for.

All three of the people inside of the car were detained while police conducted an investigation.

During a search of the driveway the vehicle had just pulled out of, officers located a sawed off .22 rifle and a black glove, which matched a glove found in the car.

The rifle, which was a prohibited weapon, had a loaded magazine attached to it and appeared to have been tossed from the vehicle into the long grass.

This fact was disturbing, described Crown prosecutor Tyler McLean, because it meant nearly anyone could have come by and picked up the loaded weapon.

"This firearm was discharged in a residential area and was abandoned, loaded, in a residential area. It could have been picked up by anybody."

On May 4, police attended a Kehewin residence in relation to an incident the day before when they found Mountain, who was known to be wanted on warrants, on the property.

Mountain got onto an ATV and drove around the house, with police not far behind.

He abandoned the ATV after a second officer blocked his way, and began fleeing on foot.

According to McLean, Mountain eventually ran out of breath and turned himself in.

Since 2002, Mountain has been convicted of 28 offences, something the Crown was considering when determining his jail sentence.

"I think nine months is appropriate," McLean expressed.

"I just want to finish my time, get out, and start fresh," Mountain told Honourable Judge Kathleen Williams.

Williams sentenced Mountain to 270 days in jail , and with 155 pre-trial days already spent behind bars, Mountain has 115 days remaining.
