Man "lucky" to be alive following assault with a weapon

Honourable Judge Kathleen Williams explained to Geraldine Moocheweines how fortunate she was that the victim of her assault walked away with minor injuries.

Elk Point RCMP responded to an assault on April 5 after an argument between Moocheweines and a male escalated.

When police and EMS attended the Frog Lake residence, they learned the accused had struck the male twice in the head with a baseball bat.

The victim was taken to the hospital while the accused was nowhere to be found.

Moocheweines was arrested the next day.

She appeared in the Bonnyville Provincial Courthouse via CCTV on Tuesday, May 28 and pleaded guilty to assault with a weapon.

According to Crown prosecutor Tyler McLean, "the level of violence here is fairly (serious)."

Williams agreed, noting it's "quite lucky" that Moocheweines didn't cause the victim more harm.

"If this is what happens when you drink, you can't drink."

The 36-year-old mother of five was sentenced to 60 days in custody. After serving 60 pre-trial days, Moocheweines was released from prison.

Moocheweines was required to provide a sample of her DNA for the national databank and is prohibited from possessing any weapons for five years.
